 Viewer, Advertiser, And Sales Terms And Conditions Agreement-

1. Copyright Protection-
   • The LowIndex.com web-site / business guide /directory / index is Copyrighted.  This Copyright is protected by United States Copyright and United States Intellectual Property Rights, as well as International Copyright and Intellectual Property Rights.
     • Because the Internet is inherently without borders, any violation of U.S. copyright protections beyond that of the United States of America, that is then downloaded and viewed / utilized within these borders, is in direct violation of U.S. Copyright and Intellectual Property laws, standards, and regulations.
     • These laws, standards, and regulations, within the United States of America, or internationally, will be enforced to their maximum protections and penalties.
     • Any party's misuse of the information, within the database of LowIndex.com, for personal or business gain, or for any other reason (ie. providing a free service), other than within the direct intent for which it has been published- to be used as an index or directory, to be viewed only by LowIndex.com viewers, users, staff, and clients and advertisers, for the purpose of connecting those who are only LowIndex.com viewers, or likewise, and paid or unpaid advertisers within the website of LowIndex.com, and who thereby agree to all terms and conditions, hereby stated- will be in direct of this here agreement, and intellectual property, but not limited to, protections and regulations.
     • This misuse, which includes the use of data mining and gathering, spiders, reproduction of ads, use or reproduction of any artwork / logos / text / font structure / inheret theme of website, or protected domain/ business structure, as well as contacting advertisers for business, or other, gain, not within the parameters of the intent, written, or implied, of the web-site LowIndex.com, is in direct violation of the viewership, and or advertiser policy of the web-site LowIndex.com, and is a direct, unobjectable, violation of United States Copyright protections, as well as the protections placed within international laws, and will be viewed as so, thereby enforced, and punished, to the maximum protections within these heresaid laws, as well as with other protections, and violations, criminal, or otherwise, of corporate espionage, misuse of company confidential information, but not limited to.
     • Any party who violates above stated terms and conditons, will be punished, and prosecuted, to the maximum protections of all these said laws, including corporate, civil, criminal, Copyright Protection, intellectual property protections, but not limited to, within United States law, or otherwise, regardless of the party's structure (ie. corporate, propriership, LLC, partnership, citizen, alien, etc.), stature, relationship (ie. employee of LowIndex.com, manager at LowIndex.com, Team Leader, past or present, for LowIndex.com,  Account Manager, past or present, for LowIndex.com, any other staff, or out-source labor, contractual or otherwise, past or present, for LowIndex.com, previous ownership, for that of LowIndex.com, advertiser or client, past or present, of LowIndex.com, employee of another advertising web-site, or distributer, or agent of, or vendor of, or representative of, or any other type of advertising medium, including, but not limited to print material, radio, billboard, radio, television, or database gathering agency, or agent of, reprentative of, employee of, contractual labor relationship of, spiders, or any other non-tangible items, in use for a specific agency, structure, person, or persons, or other party, enforceable, or punishable by law), or non-relationship to that of LowIndex.com Incorporated.
     • Any who view web-site LowIndex.com, and participate actively in LowIndex.com, must do so only with the complete agreement of this here terms and conditions agreement, and agrees to abide by all said terms and conditions, simply by logging-in, using, viewing, or otherwise participating in LowIndex.com, under the protections of LowIndex.com, Incorporated, and by willingly using and viewing LowIndex.com, within this viewer's terms and conditions agreement.
     • This contract holds true, to all those who view web-site during its time frame. The viewing party then inherently agrees to abide by the terms and conditions of this agreement, indefinately, even under the conditions of intentional misuse, hacking, altering, or otherwise changing the intent, written, or implied, and stated purpose, of any part or section of the the Viewer's, Advertiser's, And Sales Terms And Conditions Agreement, but not limited to these stated circumstances, but also including unintentional alterations, including web-site failure, misuse, accidental or otherwise, text failure, content failure, or loop-holes, or other unintentional shortcomings, beyond that of the intent written, or implied, and protections stated in this terms and conditions agreement.
     • All internal company information, documents, discussions, relationships, are viewed as confidential, and are also protected by the maximum protections and penalties of United States Copyright and Intellectual Property law, International Copyright and Intellectual Property protections, corporate law, civil law, and criminal law, and will be enforced by the maximum extent of these laws, or beyond, by that of LowIndex.com Incorporated.
     • Misuse of the web-site, or internal confidential, corporate information, includes, but is not limited to, above, and other, terms and conditions, stated within the Viewer's, Advertiser's, and Sales Terms and Conditions Agreement.
     • The information within the database index, directory, or anywhere within the web-site of LowIndex.com, or any artwork, logos, text, font styles, or even themes, templates, color schemes, or otherwise, is the sole property of LowIndex.com, and may not be duplicated, or misused, in accordance to the terms and conditions of this contract, without the written consent of the publisher.
2. Copyright Protection / Internal And External Violations / Asset Valuations-
   • Because of the fact that it often proves difficult to value assets such as intellectual property within the court of law, inside the United States, or otherwise, as a viewer, and participant, of LowIndex.com, I hereby agree to the following monetary valuations, in U.S. dollars, regardless of my relation to LowIndex.com, whether internal (past, or present)- Account Manager, Team Leader, salesperson, representative, contract labor, employee, ownership, agent, but not limited to- or any party external to the organization of LowIndex.com- individuals, persons, corporations, organizations, or any other party or structure- for the following violations of this Viewer, Advertisier, and Sales Terms And Conditions Agreement.
   • The use of cookies, data mining, spiders, or any gathering of information on the web-site LowIndex.com, through manual copying, or automated, or any other copying of the material anywhere ,within the web-site LowIndex.com, or the misuse of internal LowIndex.com company information, for any reason whatsoever, including, but not limited to personal gain, organizational gain, a free-service, or otherwise, by any party, directly or indirectly involved, is strictly prohibited.  And, violators of the Copyright Agreement within the context of the Viewer, Advertiser, and Sales Terms And Conditions, in regards to the web-site LowIndex.com, will be prosecuted to the maximum extent punishable by United States criminal, corporate, Copyright, but not limited to, laws, and, or, those laws for international intellectual property and proprietary rights, protections, and penalties.
   • Furthermore, as an active viewer / participant of LowIndex.com, by participating in this viewership, I then agree, and hereby state, that each advertisement used, stolen, or taken from the web-site LowIndex.com, or otherwise internally within the corporation LowIndex.com, in which any of its information is mined, gathered, stolen, or otherwise misused, internally or externally, to that of LowIndex.com, for any reason whatsoever, including, but not limited to personal gain, partnership gain, a free service, corporate gain, or otherwise, will have an effective monetary valuation in U.S. dollars, of $5,000, per instance.
   • Any copyright information of LowIndex.com, specifically, that is used without the express written consent of corporate ownership, including misuse or misrepresentation of the dove logo, or the brand name, trademark, but not limited to, these properties, of fraudelant, or other misuse, for personal gain, or other misuse, in accordance to this viewer, advertiser, sales agreement, shall have a valuated monetary worth of $50,000, for each instance.
   • Any text that is copied, misused, gathered, stolen, within any advertisement on the web-site LowIndex.com, or any other information or data or text, anywhere within the context of the web-site LowIndex.com, I hereby agree, in this terms and conditions agreements, by willingly participating in the web-site LowIndex.com, shall have the effective monetary valuation of $5,000 per word, per instance, $10,000 per logo, per instance.
   • Copyright, criminal law, including that of corporate theft of proprietary information, whether within United States law, or international laws, standards, and regulations, will be enforced and executed to the maximum extent punishable by these laws and protections.
   • Any misuses internally of internal LowIndex.com proprietary information such as clients, data, company procedures, structure, policies, for personal or otherwise gain, or misuse, or otherwise, will result in prosecution of all above said parties directly, or indirectly, involved.
   • Please report any and all violations, or even the perception or suspicion of any violation, of this here Viewer's, Advertiser's and Sales Terms And Conditions Agreement, to both the following:   Robert@LowIndex.com, and Erik@LowIndex.com.
3. Errors-
   • Lowindex.com always strives to publish a complete and accurate index / directory.
   • However, errors do occur.
   • The conditions and presentation of the web-site of LowIndex.com, may, like anything else, contain certain flaws, bugs, errors, etc.
   • We would appreciate all viewers, advertisers or staff of LowIndex.com, to report any errors or flaws, bugs, etc. on the web-site LowIndex.com, immediately.  Please send remarks to support@LowIndex.com.  Or, call customer support at 800-313-0331.
   • It is the responsibility of the advertiser, paid or otherwise, to report any above stated errors, etc., within the web-site LowIndex.com, to LowIndex.com, at the above stated email, or customer support phone number, as soon as possible, and within a reasonable time-frame, as viewed and interpreted, at the sole discretion of LowIndex.com.
   • LowIndex.com Incorporated is not liable for damages resulting from any ommissions, errors, etc., within the web-site LowIndex.com.
   • LowIndex.com's policy is to credit any advertiser only to the extent of the advertisement cost, for these stated errors, etc., at the sole discretion of LowIndex.com, and for a time-frame deemed reasonable, too, at the sole discretion of LowIndex.com.
   • Thereby, it is the advertiser's, and viewer's responsibility, and in their very best interest, to report these errors, flaws, etc., to LowIndex.com, as immediately as possible.
   • If any error, flaw, bug, etc., is beyond the possibility of immediate repair, or is otherwise deemed beyond that of reasonable accomadation at the sole discretion of LowIndex.com, then this error, etc., shall be repaired, or brought to a reasonable accomadation, only at the sole discretion of LowIndex.com. 
   • LowIndex.com will always attempt to reasonably accomodate any advertiser or business within the directory of LowIndex.com.  However, any credit, to any advertiser, viewer, willing participant in LowIndex.com, for the conditions stated within this Viewer's, Advertiser's, and Sales Terms and Conditions Agreement, in regard to errors, bugs, flaws, reasonable accomadations, etc. will be at the sole discretion of LowIndex.com.
4. Non-Paying Advertisers / Non-Paying Subscribers (Viewers)-  
   • LowIndex.com does not assume any responsibility, or liability whatsoever, to any non-paying advertiser or subscriber.
   • LowIndex.com, likewise, will always try to reasonably accomodate its viewers and advertisers, yet at the sole-discretion of LowIndex.com
   • Any non-paying advertiser hereby agrees to the terms and conditions stated within this contract.  LowIndex.com, is protected by the terms and conditions, of the viewer, advertiser, and sales policy within this contract, as well for non-paying advertisers or subscribers.
5. Licensing-
   • Certain headings / advertisers / businesses, or otherwise, which appear within the web-site of LowIndex.com, may require licensing by state, local, or federal agencies, or with respective trade organizations.
   • Please contact any of these above departments, to obtain, and verify, any licensing required, or otherwise, recommended.
   • It is the viewer's, user's, willing participant's, responsibility to do his or her- or corporate, or other structure, tangible, or otherwise- due dilligence as required to verify any of these requirements stated. 
   • Please contact the advertiser, and/or the appropriate trade organization, or regulatory agency. 
   • LowIndex.com does not screen its advertisers, businesses nor any other party or parties.
   • Report any complaints, or violations, to support@LowIndex.com.
   • LowIndex.com does not assume any responsibility, or liability, for the actions, or misactions, of any business, person, or any party, or parties, that appears within the web-site LowIndex.com, but not limited to the web-site.
6. Information Contained Within The Web-Site Of LowIndex.com-

   • LowIndex.com always attempts to handle and process the information within the web-site, whether confidential, or otherwise, in a manner that is responsible, and meets, or exceeds, the standards by that of most industries.
   • LowIndex.com has the right to use the information within this web-site, as a source of leads, for its staff.
   • We agree to handle any personal, business, or any party's information in a responsible manner, so as to meet, or exceed, industry standards.
   • While, LowIndex.com is a secure web-site, by most standards and policies, nothing exists that is totally, one-hundred percent secure by the actions of that of computer hackers, cookies, spiders, other devices, malicious, etc.
   • While LowIndex.com provides a valuable service to both advertisers and communities, LowIndex.com cannot assume any responsibility, nor liability, for the misuse, intentional, or not, by any parties, or actions, of any information that is contained within the web-site LowIndex.com
7. Federal Fair Housing Act of 1968-
   • All real estate advertised herein is subject to the Federal Fair Housing Act of 1968.
     • This makes it illegal to advertise "any preference, limitations, or disrcrimination based on race, color, religion, sex, or natural origin, or intention to make any such preference, limitations, or disrcrimination."
     • All viewers should be informed that all dwellings advertised, or listed, are, and should be, available on an equal oppurtunity basis.
     • LowIndex.com does not knowingly accept any advertising or listing, for any dwelling, or any real estate, that is in violation of this law.
     • Please report all abuse to support@LowIndex.com.
     • Each case will be investigated on an individual basis within LowIndex.com.
     • LowIndex.com does not assume any responsibility or liability on the part of any of its advertisers, or listings.
     • Please report any violations of the above stated law to the proper authorities within the government, federal, or otherwise, immediately.
8. Trademark Protections-
   • Lowindex.com, as well as the dove, text, logos, even theme and design of web-site, font styles and structures of logos, are all trademarks of LowIndex.com Incorporated.
9. Specials / Savings-
   • LowIndex.com, provides a valuable service for communities, and advertisers, with the displayment, and categorized thereof, of local, and national, savings, specials, promotions, etc.
   • Any specials, savings, prices, percent discounts, or any other offers made herein, are listed at the advertiser's request.
   • Thereby, the content and obligation of fulfillment, is the sole responsibility of the advertiser.
   • These offers, are subject to any and all restrictions placed within the advertisement.
   • Any fraudelent advertisement, specials, or savings, or those printed in error, are, and should be viewed as, unenforceable.
   • LowIndex.com bears no responsibility or liability on the part of its advertisers or advertisements.
   • Please report any and all abuse, or even the perception of abuse, to support@LowIndex.com.
10. Rendering Certain Listings, Advertisements, Categories, Text, Logos, or Otherwise, As Unfit For Display-
    • LowIndex.com bears the right to evaluate any and all of its posted content as either fit, or unfit, for display on the said web-site, by the sole standards, and discretion, of LowIndex.com.
    • LowIndex.com wishes to remain a site that is respectable, family friendly, child friendly, and non-offensive to those of any religious, ethnic, social-economical, racial, sexual (or any/all sexual preferences, or tendencies), as well as many other groups or minority categories, not stated herein.
    • Please report abuse, discrimination, or any other offensive material that appears on the web-site LowIndex.com to support@LowIndex.com.
    • Some examples, but not limited to, of the above stated offensive material may include pornography, hate text / statements/ otherwise, that of a morally or religiously offensive nature, that of a violent nature, that of a gruesome nature, that of any offensive nature, as viewed by the sole-discretion of LowIndex.com.
    • Other offensive material, as viewed by LowIndex.com, but not limited to these examples, may include prostitution, escort services, gambling operations, terrorist activity, or organizations, and other illegal or deemed offensive organizations (ie. gangs, drug peddlars, organized crime, unorganized crime,  hate organizations, or individuals, or content, or otherwise.)
    • LowIndex.com does not bear any responsibility, nor liability, for any of the above stated, but not limited to, orgaizations, contents, groups, individuals, text, logos, categories, etc.
    • LowIndex.com has the right to pull and cancel any advertisement- without refund- that falls within any of these examples stated, but not limited to these examples, that is deemed offensive in nature, at the sole discretion of LowIndex.com.
11. Accuracy Of Content Within Web-Site Of LowIndex.com-
    • LowIndex.com does not bear any responsibility, burden, nor liability for the accuracy of the information contained within the web-site LowIndex.com, nor for the representation, nor statements, actions, nor misactions, etc., presented, or enacted, etc., by any of its advertisers, businesses, persons, or any party, or parties, who appear on the web-site LowIndex.com.
12. Content, Conditions, And Parameters Of Viewer And Advertiser Policy-
    • While LowIndex.com staff, contractors, agents, employees, sales persons, and all those who knowingly, or unknowingly represent, or speak of, or write of, etc. on behalf of LowIndex.com, should always attempt to present LowIndex.com in both a favorable, and honest, truthful light, these statements, should fall within the parameters, and boundaries, of this contract.  Any statements by a representative of LowIndex.com not abiding to this contract, is a misrepresentation, and not part of LowIndex.com's policy.
    • LowIndex.com does not bear any responsiblity, recourse, nor liability whatsoever, for the remarks or statements, actions, or misactions, however presented, by the above said, but not limited to, parties.
    • Please report all abuse, or even perception of this abuse, to both Robert@LowIndex.com and Erik@LowIndex.com.
13. Payments-
    • It is within this agreement, simply by viewing, and willingly participating, or willingly representing LowIndex.com, etc., with regard to any representatives, employees, contract labor, agents, Account Managers, Team Leaders, even ownership, etc., to all parties involved, that all payments for any, and all, services, or actions, rendered or provided by LowIndex.com, are to be made on a credit or debit card, with the respective information, entered only within the Advertiser Sign-Up Section of the web-site LowIndex.com.
    • Any party, advertiser, business, paying customer, etc.,  hereby agrees to the above statement, and to follow this statement.  Any other payment that is executed is outside of boundaries of this contractual agreement, and may likewise be deemed as fraudalent.
    • Any other form of reimbursement, whatsoever, including, but not limited to, cash, checks, favors, etc., and as viewed as reimbursement, by the sole discretion of LowIndex.com, that is other than the above stated, and agreed upon proper method- to be made on the customer's, client's, advertiser's credit, or debit card, within the Advertiser Sign-Up Section of LowIndex.com- will be handled in a manner that is at the sole discretion of LowIndex.com, and this may include, but is not limited to, the following actions, procedures, or penalties-
      • Cancellation of any advertisement, listing, etc. without any refund.
      • Prosecution of all involved parties.
      • Permanent cancellation of any and all commissions, for all accounts, of any party involved, directly, or knowingly indirectly, including, but not limited to, Account Managers, agents, representatives, and Team Leaders.
    • I agree, as an advertiser, and, or, employee, agent, contractor for, representative of, salesperson for, Team Leader for, Account Manager for, etc., as stated herein, that the above stated action, but not limited to this statement, and sited examples, is corporate theft, and fraudelent in nature, and action, etc.
    • These actions will be punishable to the full extent of criminal, civil, corporate, and proprietary laws within the United States of America, or beyond.
    • Because often within the civil court system, it may prove difficult to place a valued worth to that of an advertiser, or advertisement, or client, etc., I hereby willingly agree, and accept, within this hereby Viewer's, Advertiser's, and Sales Terms And Conditions Agreement, to the following monetary values, based on United States dollars, for the following items, advertisers, clients, expenses, etc.-
      • Seven times the monetary amount of any advertisement, for the life of this advertisement.
      • $5,000, per instance, for each, and any customer, advertiser, etc., for the theft of this advertiser, client, advertisement, etc., whether acting internally within the company LowIndex.com, or externally, for a personal, corporate, any gain, or free-service- including, but not limited to, another web-site, directory, or service- that is outside of the realm of the stated and implied purpose of the web-site LowIndex.com, within this very Viewer's, Advertiser's, and Sales Terms And Conditions Agreement.
      • To pay all court and attorney expenses, involved in these proceedings.
      • All of the other valuations stated, and also agreed upon, within Section 2, "Copyright Valuations", of this Viewer's, Advertiser's and SalesTerms And Conditions Agreement.
      • Permanent cancellation of any, and all commissions, for all accounts, by any party, or parties, involved directly, or knowingly indirectly, for any fraudalent activity, in regards to the web-site LowIndex.com, that is deemed as such, at the sole discretion of LowIndex.com.
    • Please report any and all abuse, or even the perception of this abuse, to both Robert@LowIndex.com, and Erik@LowIndex.com.
14. Payment Process-
    • Any, and all, payments should be made on credit / debit card within the Advertiser Sign-Up Section of LowIndex.com.  Any other type of payment, reimbursement, etc. is considered invalid, possibly fraudelent (See Section 12, "Payments").
    • These will then be charged monthly, on a recurring basis, to the above stated credit / debit card.
    • Any payment, that does not properly process, for any reason whatsoever, will result in immediate cancellation of advertisement.
      • In this case, please contact support@LowIndex.com, or call customer support at 800-313-0331,to amend the situation as soon as possible.
      • Your advertisement, if cancelled, will remain on file.
      • Thereby, with a proper installment processed, your ad can immediately be reinstated.
15. Standards-
    • All advertisers, businesses, or any other individuals, groups, organizations, or party, hereby agrees to abide by those professional standards that exist within their respective trade, business, or practice.
    • Also, as a willing participant in LowIndex.com, I hereby agree to endorse any, and all, savings, promotions, and discounts, whether monetary, or percentage, etc.,within the parameters of my written advertised special on the web-site LowIndex.com, and within its proper time-frame, which includes any and all exclusively posted expiration dates, to all individuals, or any party, regardless of race, religion, ethnicity, sexual orientation, physical or mental impairment, or those that fall in category or standing, currently protected by minority protections.
    • Furthermore, as the above mentioned, I hereby agree that it is my responsibility to immediately cancel, without charge, any expired, or otherwise unacceptable, savings, promotions, specials, etc.
16. Discrimination-
    • All advertisers, businesses, or any other portrayers of information, paying or non-paying, on the web-site LowIndex.com, as well as any employees, contract labor, agents, representatives, Account Managers, Team Leaders, etc. hereby agree not to discriminate on the basis of color, race, religion, ethnicity, gender, sexual preference, handicap, physical or mental impairment, to any group, or individual, protected, or otherwise, by those protections that have been enacted by United States law, or beyond, for the rights and protections of minority, or other groups and individuals.
    • LowIndex.com does not bear any responsibility, nor liability, whatsoever by the above said parties and their actions.
    • Violations of these terms and conditions within hereby contract may result in, but is not limited to-
      • Federal, state, or local prosecution.
      • Cancellation, without refund, of any advertisement on the web-site LowIndex.com.
      • Termination of Account Managers, Team Leaders, agents, contract labor, employees, or any other who directly, or indirectly represents LowIndex.com, and violates these standards, rights, and protections.
    • Please report any and all abuse, or even the perception of this abuse, to support@LowIndex.com.
17. Report Abuse-
    • The "Report Abuse" (red) links on the display ads of each and any advertiser, on the web-site LowIndex.com, are there for the stated purpose of reporting any, and all, abuse, perceived, or actual, of any party, advertiser, or advertisement, that appears on the web-site LowIndex.com.
    • It is of the possibility that these links may not always function properly, and as intended.
    • In the above case, please notify any, and all, abuse, perceived, or actual, to support@LowIndex.com, or call customer service at 800-313-0331.
18. Use Of LowIndex.com Trademark Or Logo-
    • Some advertisers, businesses, individuals, or any party / parties, who display information with regards to the web-site LowIndex.com, may receive certain LowIndex.com Trademarks, logos, URL's, to be used for display, or referal purposes.
    • All of the above mentioned material, whether tangible, or intangible, such as per-se a web-site, including displays, stickers, brochures, URL's, etc. or any and all promotional, or non-promotional items, etc., should be represented and displayed in manner that is professional, presentable, and respectable, to most standards, and the sole discretion of LowIndex.com.
    • Any violation, or violations, to these standards, may result in cancellation, permanent or otherwise, of all relations with LowIndex.com, including, but not limited to, advertisement, print items, display items, promotional material, URL, etc.
19. LowIndex.com Liability Limitation-
    • Any viewer, advertiser, paying or non-paying, representative, employee, contract labor, agent, any willing participant, whatsoever, agrees, within this Viewer, Advertiser, and Sales Terms And Conditions Agreement, that it will  not sue LowIndex.com, for monetary damages, on recourse.
20. Advertiser (Paying Or Non-Paying) Relationship With LowIndex.com-
    • Any advertiser, business, person, or persons, organization, party, or parties, who appears on the web-site LowIndex.com, should not, and shall not, represent himself, herself, itself, etc., as a partner, nor employee of LowIndex.com, nor joint venturer, nor any sort of representative, of LowIndex.com, except for, and limited to-
      • In the case of salespersons, staff, or referals of LowIndex.com, so long as all representations are forthright, and truthful.
      • The professional displayment of any LowIndex.com URL, logo, Trademark, name, sticker, print material, web-site material, etc.
    • LowIndex.com does not, in any manner, endorse the goods, services, etc., that is on display within the web-site LowIndex.com.
    • LowIndex.com does not involve itself in dispute resolution.  Nor, does LowIndex.com bear any responsibility nor liability for any action, nor result of any action- intentional, or unintentional, direct, or indirect- of any of its advertisers, businesses, organizations, persons, groups, business structures, parties, etc., that appear within the web-site LowIndex.com.
21. Indemnification-
